First, I wanted to make an important correction to my last newsletter: The Laken Riley Act does NOT require sheriffs to honor detainers. Sheriffs in states that require cooperation with ICE will still be required to do so, and sheriffs participating in 287g can still put people covered by the LRA into deportation proceedings. But there’s no specific requirement that sheriffs detain any individual if they wouldn’t otherwise do so.
The LRA does, however, require ICE to issue detainers (for those accused of shoplifting and other non-violent crimes) and take people into custody pending deportation proceedings. I apologize for the error. Thank you to Aaron Reichlin-Melnick for the clarification.
